Terms of Service

Plain-English summary

Use audience.is only with data you have the right to process. We help import, enrich, and report audience insights, but enrichment is not perfect and should be reviewed before business use. Some access may be free, partner-included, limited, or paid as the product develops.

Who may use audience.is

audience.is is for businesses, publisher teams, BuySellAds publisher partners, and selected early-access users. You must be at least 18 years old and able to enter into a binding agreement for yourself or the organization you represent.

If you use audience.is for an organization, you confirm that you have authority to accept these terms on that organization's behalf.

Your account

You are responsible for the accuracy of account information, for protecting account access, and for activity that occurs under your account.

You must notify us promptly if you believe your account, email service provider connection, API key, OAuth token, or other credential has been compromised.

We may suspend or restrict access if we believe an account is inactive, unauthorized, harmful, fraudulent, competitive misuse, or otherwise creates risk for audience.is, our customers, or our service providers.

Customer data and permissions

You retain ownership of the subscriber lists, publication data, survey responses, and other content you provide to audience.is.

You grant audience.is permission to process customer data as needed to provide the service, including importing subscribers, deduplicating records, syncing integrations, enriching data, generating reports, securing the product, and providing support.

You are responsible for having the rights, permissions, notices, and legal bases needed to provide subscriber data to audience.is and to use the resulting audience insights.

Do not upload sensitive personal information, regulated health information, payment card data, government identifiers, or children's data unless we have agreed in writing to support that use case.

Subscriber enrichment and accuracy

audience.is enriches subscriber records using automated systems and third-party data sources. Enrichment results may be incomplete, stale, incorrect, or unavailable for some records.

Confidence scores and match rates are quality indicators, not guarantees. You should review outputs before relying on them for sales, compliance, targeting, or business decisions.

We may deduplicate records, skip records, throttle processing, or change enrichment workflows to control cost, protect reliability, prevent abuse, or improve quality.

Integrations

When you connect an email service provider, you authorize audience.is to access that account or list according to the permissions granted through API keys, OAuth, or other credentials you provide.

You are responsible for complying with the terms of the connected provider. We are not responsible for changes, downtime, rate limits, data errors, or policy decisions made by third-party providers.

Acceptable use

You may not use audience.is to violate law, infringe rights, send spam, build unlawful profiles, reidentify deidentified data, probe or attack systems, scrape the product, resell access without permission, or upload data you do not have the right to process.

You may not use the service to evaluate audience.is for a competing product or to copy product features, designs, workflows, or data models without our permission.

Fees and availability

Some features may be free, included for BuySellAds publisher partners, offered as early access, usage-limited, or paid. Pricing, included usage, limits, and packaging may change as the product develops.

If paid features are enabled for your account, the applicable order form, checkout, invoice, or written agreement will control billing details. We may suspend paid features for nonpayment.

Product changes

audience.is is an evolving product. We may add, remove, suspend, or change features, integrations, limits, reports, enrichment methods, and user interface flows.

We will try to avoid unnecessary disruption, but we do not guarantee that any feature, integration, or third-party data source will remain available forever.

Confidentiality

Non-public product, business, technical, customer, and subscriber information shared through audience.is should be treated as confidential.

You may use confidential information only to use or evaluate audience.is, and you may not disclose it except to people who need it for that purpose and are bound by similar confidentiality obligations.

Intellectual property

audience.is, including the product, software, designs, workflows, reports, documentation, branding, and underlying technology, belongs to us and our licensors.

These terms do not grant you ownership of audience.is. You may use the service only as allowed by these terms.

Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, and error-free operation.

audience.is does not provide legal, compliance, tax, financial, or advertising advice. You are responsible for how you interpret and use audience insights.

Limitation of liability

To the fullest extent permitted by law, audience.is will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.

To the fullest extent permitted by law, our total liability for claims relating to the service will not exceed the amount you paid to audience.is for the service in the three months before the claim, or $100 if you have not paid us.

Termination

You may stop using audience.is at any time. You can request account or data deletion by contacting hello@audience.is.

We may suspend or terminate access if you violate these terms, create risk, stop working with us where access depends on that relationship, or if we discontinue the service.

Governing law and disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of law rules.

Before filing a claim, both sides agree to try to resolve the dispute informally by emailing hello@audience.is and giving the other side a reasonable opportunity to respond.

Changes to these terms

We may update these terms as the product, business, or legal requirements change. If changes are material, we will take reasonable steps to notify customers. Continued use of audience.is after an update means you accept the updated terms.
